Openstageit provides a subscription service that allows our members to manage their community of fans and to advertise events, allow for communication and understand demand through the use of the tools and capabilities of the platform (referred to in these terms as “Openstageit service” and “our service”). The Openstageit service is provided over the Internet and may be integrated with social media platforms through computers and other devices ("Openstageit ready devices").The Openstageit service is provided to you by OPENSTAGEIT LIMITED, a company registered in England and Wales under company number 08322164 (referred to in these terms as “us”, “we” and Openstageit”.These terms govern your use of our service.
2.1. Billing Cycle. The membership fee for the Openstageit service and any other charges you may incur in connection with your use of our service, such as taxes and possible transaction fees, will be charged on a monthly basis to your Payment Method on the nearest practicable calendar day corresponding to the commencement of the paying portion of your membership. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month. Visit our website and click on the "Personal Details"link on the "Your Account" page to see your next payment date.
2.2. Payment Methods. You can change your Payment Method by visiting our website and clicking on the "Your Account" link. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not change your Payment Method or cancel your account, we may suspend your access to our service until we have obtained a valid PaymentMethod. When you update your Payment Method, you authorize us to continue charging the updated Payment Method, and you remain responsible for any uncollected amounts. This may result in a change to your payment billing dates.For some Payment Methods, the issuer of your Payment Method may charge you certain fees, such as a foreign transaction fee or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on thePayment Method used. Check with your Payment Method service provider for details.
2.3. Cancellation. You may cancel your Openstageit membership at anytime, and you will continue to have access to the Openstageit service until the end of your then current billing period. To the extent permitted by the applicable law, payments are non-refundable. Unless we elect to terminate your membership when you are not in breach of these or other applicable terms, we do not provide refunds or credits for any partial membership periods. To cancel, go to the "Your Account" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click "Personal details" on the "MyAccount" page.
2.4. Changes to thePrice and Service Plans. We may change our service plans and the price of our service from time to time provided that in the case of a change to the price of your plan you will be given no less than 30days’ notice of the proposed change and that price change will not take effect until the next billing period starting after that 30-day period has expired. We may withdraw or change the price payable for additional paid-for services at any time.
3. Openstageit Service
3.1. You must be 18 years of age, or the age of majority in your province, territory or country, to use the Openstageit service. Minors may only use our service under the supervision of an adult. 3.2. The Openstageit service is available for use within the web and app based platform and with the tools available through the login and my account profile pages.
- 3.2.1.Artist profile page - 3.2.2.Fan geolocation (fans placing magnets, informing where they are based, how far they would travel and the price they would be willing to pay to see the artist perform (Desire) - 3.2.3.Geo-Funding (initiating a queue -sharing that queue with other fans, creating a demand for a performance in a given location and providing their payment details to ensure access to tickets if the queue converted to a live performance) Event promotion (the artist, based on magnet data, promoting a live event to the fans who have placed magnets, based on where the greatest desire to see the artist perform is located) - 3.2.4.Administration tools (providing access to the location, contact information, mailing and other communication tools. Maximum number of emails per account is 1000 sent per month, this number can be altered by Openstageit on 30 days notice; subsequent emails can be acquired as advertised on the Openstageit website or on request)
3.3. Openstageit regularly makes changes to our service which will become available to you through the login and other features of the site and app.
4. Passwords andAccount Access. The member who created the Openstageit account and whose Payment Method is charged (the "Account Owner") has access and control over the Openstageit account. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should not reveal the password nor details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We may terminate or suspend your account (but are under no obligation to do so) in order to protect you, Openstageit or any other person from any identity theft, fraudulent activity or breach of these terms.
5.2. UnsolicitedMaterials. Openstageit does not accept unsolicited materials or ideas for Openstageit content, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted using our service.
5.3. Customer Support. To find more information about our service and its features or if you need assistance with your account, please visit the Openstageit Help Centre on our website (https://www.openstageit.com/faq).
5.4. Survival. If any provision or provisions of these terms shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
5.5. Changes to Terms. Openstageit may, from time to time, change these terms. If the changes affect the amount that you are required to pay for your membership service plan we notify you at least 30days before the change take effect.5.6. ElectronicCommunications. You agree that we may send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form, for example via emails to your email address provided during registration.
